Fact Finding: Rape of a minor girl

On the 9th  of July 2012 at midnight, K. Latha (name changed) an unidentified man entered into the house and took her to a mango farm, which is 2 km away from the victim’s home. K. Latha‘s mouth and hands were tied with a rope and she was brutally raped by the unidentified man. After that K. Latha was beaten by wooden sticks and bricks, which caused external injuries to her. The unidentified person kept Latha in his custody for the whole night. The accused also threatened Latha that if she reveals the incident to her family members, he will kill her family and set her house on fire. On the next day in the early morning around 4 am Latha escaped from him and returned to her house. Latha’s parents filed a complaint at G-3 Salavakkam Police Station on 10th July 2012. But case was registered by the Police only on 11.7.2012 with FIR No. 319/12 U/Sec 451,323,376 of IPC.

Filed a petition at Madras High Court (Criminal Original Petition No.8513 of 2013) praying to alter the FIR, provide relief to the petitioner and expeditiously complete the investigation and Charge Sheet filling. The Madras High Court directed the Judicial Magistrate Uthiramerur to conduct the proceeding within one month. The case was transferred to the Chengalpat, Mahila Court 32K/2014.
